| 标准必要专利由于其封锁效应和强制适用，成为其他经营者无可替代的选择。由此，专利权人极易利用这种优势地位，滥用标准必要专利，实施垄断行为。我国《反垄断法》实施时间不长，对于滥用标准必要专利行为的规制立法较为滞后，与传统工业国家的反垄断规制相比，在滥用标准必要专利的认定标准和规制措施上都存在着重大差异。清晰辨识滥用标准必要专利行为并对其依法规制是保护我国市场竞争秩序和社会公共利益的时代要求。 |

| Hence borned the standard necessary patent. It has become other companies' best choice for its blockade effect and mandatory application. As a result, the patentees are easy to abuse the privilege and to implement monopoly behaviors. The regulation legislation of standard necessary patent is relatively lag for it was not a very long time since our country's Antitrust Law took effect. And compared with the traditional industrial age' antitrust regulation, there is a great gap between standard necessary patent's permission and methods of regulation. Therefore, in the era of globalization, knowledge innovation, and technology development, it is the call of an ordered market competition and satisfied public interests to clearly identify criteria necessary patent abuse behaviors and regulate them by law. |
