| "人工智能文生图第一案"为《中华人民共和国著作权法》(以下简称《著作权法》)对作品的保护带来了新的挑战,也激起了学界对AI文生图内容是否应得到著作权法保护的新一轮讨论。在理论基础上,将AI文生图内容认定为作品是其受著作权法保护的前提,公共产品理论、邻接权保护的不适配性体现了该路径的必要性;类型思维、著作权的激励机制以及《著作权法》的立法目的更从理论上对必要性形成强化。在制度价值上,通过著作权法对AI文生图内容形成保护,亦可充分体现我国政策导向并充分发挥生成内容的价值性。在具体保护路径上,应立足于《著作权法》及其司法解释关于"作品"的描述性规则,从"文学、艺术和科学领域内""以一定形式展现""具有独创性"以及"智力成果"四个角度,结合个案特征综合判断AI文生图内容是否具有作品属性。 |

| The landmark case concerning AI-generated text-to-image content has posed new challenges to copyright protection under China's Copyright Law, sparking renewed academic debates about whether such content should be legally protected. Theoretically, recognizing AI-generated text-to-image content as a "work" is a prerequisite for copyright protection. The inadequacy of public goods theory and related rights protection highlights the necessity of this approach, while type-based reasoning, the incentive mechanism of copyright, and the legislative intent of the Copyright Law further reinforce its theoretical validity. Institutionally, protecting AI-generated text-to-image content through copyright law not only reflects China's policy orientation but also maximizes the value of such generated outputs. For practical implementation, courts should base their judgments on the Copyright Law and its judicial interpretations concerning the criteria for "works," evaluating four key aspects: "within the fields of literature, art, and science," "presented in a specific form," "originality," and "intellectual achievement," while considering case-specific characteristics to determine whether AI-generated text-to-image content qualifies as a work. |
