Malicious complaints have seriously undermined the operational order of E-commerce platforms and disrupted their normal business operations. As the country advocates for the construction of a law-based business environment, regulating the adverse effects of malicious complaints on E-commerce has become a general trend. In addition to explaining the "notice-and-takedown" rule, this paper examines judicial cases of malicious complaints and the emerging practice of reverse behavior preservation in recent years. It analyzes the criteria for applying reverse behavior preservation and how courts decide to implement it, ensuring that the interests of all parties are properly protected. The paper also explores optimal solutions to address malicious complaints and maintain a healthy business environment for E-commerce platforms. |
