| AI绘画快速发展的同时，可能导致对现有美术作品著作财产权和著作人身权的侵权法律风险，且难以构成合理使用抗辩。由于AI绘画技术的特点，现行著作权法律制度难以有效规制AI绘画的著作权法律风险。因此，在现有立法基础上，对于合理使用制度、常规侵权处理方式和法定许可制度进行补充、创新，并结合不同使用场景具体适用，将是AI绘画著作权法律风险有效的防范路径。 |

| With the rapid development of AI painting, it may lead to legal risks of infringement of property rights and personal rights of existing works of art, and it is difficult to constitute a reasonable use defense. Due to the characteristics of AI painting technology, the current copyright legal system is difficult to effectively regulate the copyright legal risks of AI painting. Therefore, on the basis of the existing legislation, it will be an effective way to prevent legal risks of AI painting copyright by supplementing and innovating the fair use system, conventional tort handling methods and statutory licensing system, and applying them in combination with different use scenarios. |
