| 当发生互联网直播侵权纠纷，对相关主体法律责任进行认定时，电子证据的作用举足轻重。不同的互联网直播主体，对互联网直播中的电子证据收集难易度并不相同，因此由哪一方主体来进行电子证据的收集，又如何实现电子证据的举证，对于互联网直播侵权纠纷诉讼的当事人十分重要。结合相关司法实务，针对互联网直播侵权纠纷中相关主体举证难、举证不合法的问题，通过电子证据合法收集，互联网直播侵权纠纷举证责任倒置，电子证据举证原则完善，实现互联网直播侵权纠纷依法治理。 |

| When online live broadcast infringement disputes occur, electronic evidence plays an important role in determining the legal liability of relevant subjects. Different Internet live broadcast subjects have different degrees of difficulty in collecting electronic evidence in the Internet live broadcast. Therefore, it is very important for the parties involved in the internet live broadcast infringement dispute litigation to determine which party should collect electronic evidence and how to provide evidence. In combination with relevant judicial practice, in view of the difficulty and illegitimacy of providing evidence for relevant subjects in online live broadcast infringement disputes, through the legal collection of electronic evidence, the onus of providing evidence in online live broadcast infringement disputes is reversed, and the principle of providing evidence in electronic evidence is improved, so as to achieve the legal governance of online live broadcast infringement disputes. |
