近年来,信用经济在人们的生活中越来越普遍,交易市场中所有权保留制度得到了广泛的应用,且应用范围逐渐扩大。将出发点定为所有权保留制度,从而将买主意图以及卖主债权实现平衡状态,因此买主期待权一词出现了。在我国现行的法律中,由于期待权的性质比较复杂,所以未对其进行明确的规定,也正因为如此买主期待权的权益受到了一定的限制,当买主期待权受到侵害时,无法进行有效的维权。以普通动产所有权保留买卖下的第三人之法律地位为选题,意图通过将所有权保留中各方当事人的权利义务关系和利益进行深层剖析,有助于进一步完善买主期待权,从而更好地发挥买主期待权的权益,并实现期待权的学术意义。 |

In recent years, the credit economy has become more and more common in people′s lives, and the ownership retention system in the trading market has been widely used, and the scope of application has gradually expanded. The starting point is the system of retention of title, so that the buyer′s intention and the seller′s claim can be balanced, so the term buyer′s expectation right appears. In the current laws of our country, due to the complex nature of the right of expectation, there is no clear provision for it, and it is precisely because of this that the rights and interests of the buyer′s right of expectation are subject to certain restrictions. This paper takes the legal status of the third party under the retention of ownership of ordinary chattels as the topic, and intends to further improve the buyer′s expectation by deeply analyzing the rights, obligations and interests of all parties involved in the retention of ownership. To give full play to the rights and interests of the buyer′s right of expectation, and to realize the academic significance of the right of expectation. |
