| 代购毒品行为是毒品犯罪的新型行为表现，代购毒品行为由于缺少刑法的明确规定导致在理论与实践中对其性质存在不同的认识。代购毒品行为的概念不同于日常生活的代购行为和民法委托的概念，在外延上需要以有偿与否、行为独立、隐名显名为标准区别于居间介绍毒品行为。代购毒品构成贩卖毒品罪需要具有牟利目的的主观条件，但是对牟利目的需要扩大解释。不同的代购行为其触犯的罪名有所不同，对于代购蹭吸与少利低利代购也需要区分不同情况予以正确认定。 |

| Drug purchasing behavior is the new behavioral expression of drug criminal. Drug purchasing behavior cause the different views in theory and practice in order to lacking the specific stipulation of criminal law. The concept of drug purchasing behavior is different from the purchasing behavior in daily life and entrust in civil law. Drug purchasing behavior need be differed from intermediary behavior by the standard of profit, independent behavior and deal name. Drug trafficking need the propose of making profit, but the content of propose should be enlarged. Different drug purchasing behavior is different in charges. the behavior of rub suction and the the purchasing behavior of less profit should be right analyzed in different situation. |
