      围绕"住改商",人们展开了长期的争论,法律至今未能提出妥善的解决办法.要设计出公正合理的法律制度,就必须对"住改商"进行全面的利弊考察与公正的价值衡量,以求得多方利益的基本平衡.片面的禁与放均是不可取的,而应当采取疏的态度,通过事前控制与事后救济的具体措施,对"住改商"予以合理的法律规制,以尽量消除其弊端,引导、规范其发展.
英文摘要:
      There’s long-time argument on the topic of converting residence to commercial building,and an appropriate legal solution is still absent.A fair and reasonable legal system assuring balance of multilateral interests must be built on the base of comprehensive analysis of advantages and disadvantages and just value assessment.Neither Partial prohibition nor permission is advisable.Instead,the attitude of channeling should be adopted.Reasonable legal regulation can be obtained through the concrete measures of pre-incident survey and subsequent relief which can eliminate the disadvantages as much as possible and direct the practice of converting residence to commercial building.
