| 无意思联络的数人侵权是指数人事先并无共同的意思联络,其加害行为相结合而致生同一损害结果的侵权类型,可以将其分为损害可分和损害不可分两种.其中,损害可分的无意思联络的数人侵权是单独侵权,数行为人承担按份责任;损害不可分的无意思联络的数人侵权是共同侵权,数行为人对外承担连带责任,对内则主要按过错程度或平均分担责任. |

| Plural-party tort without intention communication is a kind of tort where several people have no communication of intentions in advance,but their infringing acts combine to produce the same damages,which fall into two types: the type with dividable damages and the type with undividable damages.The first type is separate tort in which the infringing parties assume separate liabilities and the later is joint tort in which the infringing parties assume the joint and several liability and sort out their respective contributions between themselves according to their faults or equity. |
