| 提单自问世以来,在国际货运和国际贸易中一直扮演着重要角色.然而随着航海技术的进步等原因 ,传统的提单流转过程不能适应这种快捷的变化.无单放货频频发生, 给理论和实践带来难题.从无单放货的表现形式入手 ,分析了"无单放货"行为违约和侵权的性质,并提出了相应的应对措施,希望为实践问题提供理论支撑. |

| The bill of lading has played an important role all the time in international transportation and trade domain since its emergence.But with the development of navigation technology,the circulation of the traditional bill of lading can’t adapt to such swift change.The frequency of delivery of goods without production of original bills of lading gives rise to many conundrums in theory and practice.This article analyses its nature of breaking a contract and infringing right under the manifestation of delivering goods without production of original bills of lading.Then homologous measures are brought forward so as to give theorectical support to the practice. |
