| 从现行立法与司法实践判断,农村土地承包经营权是一种具有债权性质的不纯粹物权.用益物权的制度性优势、市场经济的逐步成熟、我国农村在土地使用中的矛盾,都显示出土地承包经营权物权化的必要性与紧迫性.鉴于我国在土地权利的建设方面重管理、轻权利,以债权代替物权等现状,应加强宪法对私权的保护、理顺目前土地使用制度中各种权利的关系,适时建立我国的土地用益物权制度,并注重配套法律制度的建设与完善,以加快土地承包经营权物权化的进程. |

| Judging by present legislation and judicial practice,the rural land contracted-management rights is an impure property right with obligatory attribute.The superiority of the benefited real right system,the progressive maturity of market economy and the knot in the use of rural land in our country all demonstrate the urgency of the realization in its real-rightize.Seeing that management is regarded highly and civil right is despised,we should strengthen the constitution to protect civil rights,harmonize relations amid all rights in land utilization system,establish the land benefited real right system and attach more importance to the construction and improvement of the related legislation to accelerate the progression of the real-rightize of rural land contracted-management rights. |
