| 表见代理制度对于维护交易安全具有重要意义,但当前有关表见代理的法律规定过于笼统,缺乏可操作性,尤其在判定相对人主观上有无过失问题上,没有客观合理的衡量标准.本文借鉴法学和经济学的相关研究成果,从成本--效益分析角度入手,对上述问题进行具体探讨. |

| The system of agency by estoppel is significant to protect the safety of transaction,but the present law concerning agency by estoppel is relatively sketchy and inconvenient to put in practice.Especially,there is no objective and rational criterion on judging the counterpart’s negligence.In light of the research on law and economics,and by virtue of the cost-income analysis,we can probe into the questions mentioned above. |
