| 为私人使用而复制作品(以下简称私人复制)是传统著作权法所规定的合理使用制度中的经典条款,但随着科学的发展和技术的进步,这一条款受到了前所未有的质疑和挑战.世界各国的立法者为平衡著作权人和使用者的利益,对传统的为私人使用而复制作品的制度都作出了适当的修正.在借鉴他国经验的基础上,力图建构起一套适合我国国情和立法现状的为私人使用而复制作品的制度. |

| Duplicating for personal application is a classical clause in fair dealing ordained by traditional copyright law. But with the development of science and technology, this clause is being questioned and challenged. To balance the interests of the writer and the user, the legislature amended the traditional clause on personal duplicating. This thesis aims to build a system which suits both Chinese circumstances and the legislation conditions with reference to other counties. |
