| Based on the legislative attitude to procuratorate’s power of conditional non prosecution and relatable prescript of penal code, procuratorate is set dowan a precondition that material circumstances of a crime is minor for exerting conditional non prosecution. Interpreted material circumstances of a crime as circumstances of imposing penalty is beneficial to exert the positive function of the conditional non prosecution power. |
