The controversy about the goal of civil litigation is massive, especially in civil law family. Japanese scholars also convey their viewpoint. In domestic, the topic is not discussed fiercely. The author tentatively express the superficial point, and thinks that civil litigation must aim at the balance of interest and the guarantee of proceedings.
